GENERAL TERMS:

• We reserve the right to refuse service to anyone for any reason at any time.
• We reserve the right to refuse or cancel any order, in whole or in part, that is placed at www.socuteappliques.net
• We reserve the right to cancel your subscription and terminate your account at any time without notice.
• You acknowledge that all sales are final. Products are non-refundable and non-returnable.
• It is your responsibility to download your designs after purchase and securely back up all files. Download links will not be guaranteed to work after 7 business days.
• It is your responsibility to keep updated billing & shipping information on your account.
• Colors may vary.

SHIPPING TERMS:

• Shipping prices are listed at time of checkout and include handling and processing.
• Handling and Processing includes but is not limited to: Envelopes, packaging, labels, misc. product packaging and direct labor. These shipping prices are subject to change without any notice.
• Orders will be shipped USPS first class mail unless the weight requires USPS priority mail. There is no insurance available on first class packages and only $50 on priority. If you would like more insurance on your package it is your responsibility to reach out through email; melisa@socuteappliques.net  prior to checkout for a custom order link to accommodate your request. Pretty Piggys Boutique LLC will not be responsible for loss if no extra insurance is purchased.
• Shipping will not be combined for multiple purchases.
• Shipping is non-refundable.
• We ship to the confirmed PayPal address to protect our customers and ourselves from fraud. It is your responsibility to have the address confirmed with PayPal if you need your package sent to a different address.
• Pretty Piggys Boutique LLC is not responsible for lost or damaged packages after your order is turned over to the shipping service.
• We do NOT offer local pickup at this time
• In the event of a lost, damaged, or stolen package it is the responsibility of you (“the customer”) to reach out to USPS and start a claim.
• We offer Route insurance to protect your order. It is up to you to purchase this additional insurance. If you choose not to purchase the additional insurance Pretty Piggys Boutique LLC will be limited on the amount and type of help we can provide if your order is lost, damaged or stolen.

INACCURACIES, ERRORS, and OMISSIONS:

Although we do our best to ensure all information on www.socuteappliques.net is accurate, we reserve the right to correct any errors at any time. This includes but is not limited to product descriptions, pricing, promotions, offers, and availability. We reserve the right to cancel any orders if needed.

COUPONS, DISCOUNTS, and SALES:

We reserve the right to cancel, end, or discontinue any sale, coupon or discount at any time. Coupon codes are required to be applied prior to checkout, you will not be reimbursed for any coupon code, sale or discount that was not applied to your cart. It is your responsibility to make sure the codes are applied and your total is correct prior to completing your purchase. Sales are subject to end without notice. Coupon codes that are applied incorrectly or without permission, on your own or through a 3rd party website, app, or add-on may cause your order to be canceled and your account terminated.

COPYRIGHT & TRADEMARK DISCLAIMER:

Although Pretty Piggys Boutique LLC makes every effort to check the current copyrights and trademarks, before creating artwork, it is ultimately your responsibility to check that there are no legal limitations for your intended usage. By using www.socuteappliques.net you agree to indemnify, defend and hold harmless Pretty Piggys Boutique LLC, its officers, directors, employees, agents and suppliers for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use or any item on this site.

REFUNDS, CANCELATIONS AND EXCHANGES:

All sales are final. If you make a duplicate digital purchase you are welcome to swap it with a different digital design of equal or lesser value. We reserve the right to issue refunds at our discretion. Refunds will be issued as store credit and if for any reason a refund is issued through PayPal, the customer (“YOU”) will be responsible for any fees that occur from the original transaction. We reserve the right to charge a restocking fee that can/will vary between 15-35%

RETURNED PACKAGES:

Returned packages due to an incorrect address is solely the responsibility of the customer (“YOU”) We ship to the confirmed address on PayPal. It is your responsibility to keep your account information up to date. If a package is returned to us, the sender, you will be contacted through email to set up a payment option to have your order reshipped. If we are unable to contact you after 30 days, you will be issued a partial refund minus original shipping and 35% restocking fee.

MISSING AND/OR DAMAGED SCREEN PRINTS:

We do our best to ensure your order ships complete and that your screen prints are in great condition. If your order arrives and isn’t correct, please contact us immediately. You have 15 business days from the date of arrival to alert us to any issues regarding your order. We require a copy of the invoice that was in your package so we can see who packed your order and ensure that all the proper steps were followed. Please email your invoice along with what your issue is to: melisa@socuteappliques.net. It will be up to the discretion of Pretty Piggys Boutique LLC whether to resend new prints or issue a refund. 

CHARGEBACKS:

We reserve the right to dispute any chargeback to the fullest extent allowed and to terminate any account at any time for failure to pay if a chargeback is initiated. Please contact us if you have any issue regarding a payment transaction. melisa@socuteappliques.net

DISCLAIMER OF WARRANTY:

You expressly agree that use of the Site is at your sole risk and discretion. Any and all designs available on this website, www.socuteappliques.net, are the sole property of Melisa Parker and Pretty Piggys Boutique LLC unless stated otherwise. As such the copyright of said artwork/designs will forever remain the property of Melisa Parker and Pretty Piggys Boutique LLC. Purchasing from this website does not transfer any ownership to you.

Designs available on this website are laid out into separate categories and as such have different allowable usages. The policies for each category are listed below. By making any purchases from www.socuteappliques.net you are agreeing to and are bound by the general usage policies as well as any/all policies associated with each category.

GENERAL USAGE:

These policies apply to ALL categories and designs available on www.socuteappliques.net.

• Copying, tracing, sharing, selling, licensing, renting, transferring, giving away, distributing, reproducing, hosting, exploiting or uploading any artwork or design found on www.socuteappliques.net, to another website is strictly prohibited.
• Modifying or making derivative works is not allowed.  
• Sending any artwork to a print shop to have the design created for you is also strictly prohibited
• You may not under any circumstances use any design, in whole or in part, to create a new design you intend to sell
• Claiming any artwork or design as your own is prohibited
• Any picture you use to advertise a design from www.socuteappliques.net or any of it’s social media sites must be watermarked
• It is strictly prohibited to convert any artwork or design into an embroidery design
• Refunds, exchanges, or returns are not offered. ALL sales are final.

 

SCREEN PRINTS:

Screen Print transfers are made with Plastisol ink on heat release paper.

• Screen Prints (also referred to as transfers) are not intended for RESALE. The license included with the purchase of any screen print allows the purchaser (“you”) to apply the transfer to a finished product and sell the finished product. Since the artwork is the sole property of Melisa Parker and Pretty Piggys Boutique LLC unless otherwise stated, the resale of any transfer in it’s original form is prohibited.
• These transfers are not intended for wholesale use.
• Screen Print transfers must be applied using a heat press. The recommended settings are listed in the description of each transfer. Each heat press is different and it is recommended that you test press several pieces to find what settings work best for you. Pretty Piggys Boutique LLC will not be responsible for errors involving the application of any transfer.
• Colors may vary. Every effort is made to ensure an accurate representation of colors. Colors cannot be guaranteed to match between different “batches” or “restocks” and refunds are not offered for such color differences.
• Sizes are listed in the description of each transfer. The designs either run horizontal (landscape) or vertical (portrait) and the sizes will represent that. The biggest measurement will coordinate with the longest side of the transfer.
• Refunds, exchanges, or returns are not offered. ALL sales are final.
• If there is a problem with your order please contact me within 14 days of receiving your package. melisa@socuteappliques.net Please include a copy of the invoice that was in your package along with your order number and any pictures to better explain your issue.
• RUSH ORDER: The rush order option that is available on www.socuteappliques.net does not guarantee delivery by a certain date. The rush option will only guarantee that your package will be packaged and shipped within the stated time frame that is listed at time of purchase. We cannot control nor will we be held responsible for any delays caused by USPS, UPS, Fed-Ex or any other delivery service that is used. YOU MUST EMAIL melisa@socuteappliques.net AFTER YOU PURCHASE THE RUSH OPTION.

 

SVG Downloads:

SVG downloads, also known as cutting files, come in SVG, EPS, DXF and PNG formats. You must have working knowledge of your cutting machine and software to use these designs.

• The sale of any transfer, stencil, or decal created using any design, in whole or in part, from the SVG category on www.socuteappliques.net is strictly prohibited. Transfers or decals include but are not limited to; sublimation, screen print, vinyl, paper or stickers.
• Uploading any design in the SVG category to any POD, print on demand, site is prohibited. This includes but is not limited to: Zazzle, café press, Red Bubble, Printful, Printify, Amazon Merch, VistaPrint, etc.
• Refunds, exchanges, or returns are not offered for any digital purchase. If you make a duplicate purchase of a design, you will be allowed to swap it out with a different design. You will need to email: melisa@socuteappliques.net in order to facilitate this swap.
• Small commercial use is allowed. Small commercial use is described as 100 pieces created per design. Mass production is never allowed. If you intend to create more than 100 pieces you will need to contact melisa@socuteappliques.net to set you up the appropriate license.

Embroidery Downloads:

All embroidery downloads come in a zip folder that includes 7 formats. .pes, .xxx, .jef, .exp, .vip, .dst, .hus 

You must have a working knowledge of your embroidery machine and a means to transfer your design to your machine.

• Embroidery designs are NOT to be resized, altered, or re-digitized.
• Embroidery designs come in different sizes, the sizes are listed in the description of each design. You must be aware of the hoop sizes your machine can use. Actual stitch counts and finished sizes are shown in the extra pictures on each listing.
• Due to the large stitch counts and density of these designs it is recommended that you use the proper stabilizer. Failure to do so can/will result in poor quality stitch-outs, bunching, outlines not lining up, skipped stitches, knots, wholes, broken needles, etc.
• Please be aware of the layout of the design. The measurements will coordinate with that. You can see the layout and measurements in the additional photos of each product.
• Refunds, exchanges, or returns are not offered for any digital purchase. If you make a duplicate purchase of a design, you will be allowed to swap it out with a different design. You will need to email: melisa@socuteappliques.net in order to facilitate this swap.

  • 3rd party printing is not allowed. You are only allowed to sell transfers that you create with equipment you own and operate. Transfers include but are not limited to sublimation, screen print, and HTV.

LoveSCA Memberships:

LoveSCA membership is a recurring subscription that will be charged to you monthly.

• You are required to cancel your membership on your paypal account if you choose to cancel
• Refunds will not be issued if your subscription renews due to failure to cancel
• You can cancel your membership at any time. Your membership benefits will expire at the completion of your subscription.
• Terms of the membership can be changed at any time. We will alert you about any changes by emailing the address on file. It is your responsibility to maintain correct information. If your email is incorrect it will be assumed that you waive any right to receive specific notice of such changes.

The use and distribution may occur in any media formats and through any media channels.

This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site.

You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Site; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria:

(1) you should have firsthand experience with the person/entity being reviewed;

MOBILE APPLICATION LICENSE

Use License

If you access the Site via a mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Terms and Conditions.

You shall not:

(1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the application;

(2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the application;

(3) violate any applicable laws, rules, or regulations in connection with your access or use of the application;

(4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the application;

(5) use the application for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended;

(6) make the application available over a network or other environment permitting access or use by multiple devices or users at the same time;

(7) use the application for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the application;

(8) use the application to send automated queries to any website or to send any unsolicited commercial e-mail;

(9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the application.

Apple and Android Devices

The following terms apply when you use a mobile application obtained from either the Apple Store or Google Play (each an “App Distributor”) to access the Site:

(1) the license granted to you for our mobile application is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms and conditions;

(2) we are responsible for providing any maintenance and support services with respect to the mobile application as specified in the terms and conditions of this mobile application license contained in these Terms and Conditions or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the mobile application;

(3) in the event of any failure of the mobile application to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the mobile application, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the mobile application;

(4) you represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties;

(5) you must comply with applicable third-party terms of agreement when using the mobile application, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the mobile application;

6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Terms and Conditions, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these Terms and Conditions against you as a third-party beneficiary thereof.

SOCIAL MEDIA

As part of the functionality of the Site, you may link your account with online accounts you have with third-party service providers (each such account, a “Third-Party Account”) by either: (1) providing your Third-Party Account login information through the Site; or (2) allowing us to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account.

You represent and warrant that you are entitled to disclose your Third-Party Account login information to us and/or grant us access to your Third-Party Account, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account, and without obligating us to pay any fees or making us subject to any usage limitations imposed by the third-party service provider of the Third-Party Account.

By granting us access to any Third-Party Accounts, you understand that (1) we may access, make available, and store (if applicable) any content that you have provided to and stored in your Third-Party Account (the “Social Network Content”) so that it is available on and through the Site via your account, including without limitation any friend lists and (2) we may submit to and receive from your Third-Party Account additional information to the extent you are notified when you link your account with the Third-Party Account.

Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts may be available on and through your account on the Site.

We make no effort to review any Social Network Content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and we are not responsible for any Social Network Content.

You acknowledge and agree that we may access your email address book associated with a Third-Party Account and your contacts list stored on your mobile device or tablet computer solely for purposes of identifying and informing you of those contacts who have also registered to use the Site.

You can deactivate the connection between the Site and your Third-Party Account by contacting us using the contact information below or through your account settings (if applicable). We will attempt to delete any information stored on our servers that was obtained through such Third-Party Account, except the username and profile picture that become associated with your account.

SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are non-confidential and shall become our sole property. DISPUTE RESOLUTION

Option 1: Any legal action of whatever nature brought by either you or us (collectively, the “Parties” and individually, a “Party”) shall be commenced or prosecuted in the state and federal courts located in Oklahoma County, Oklahoma, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms and Conditions. In no event shall any claim, action, or proceeding brought by either Party related in any way to the Site be commenced more than 3 years after the cause of action arose.

Option 2: Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms and Conditions (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Binding Arbitration

If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”), both of which are available at the AAA website www.adr.org.

Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. 

The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party.

The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Oklahoma County, Oklahoma.

Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.

If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Oklahoma County, Oklahoma, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

Application of the United Nations Convention on Contracts for the International Sale of Goods and the the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms and Conditions.

In no event shall any Dispute brought by either Party related in any way to the Site be commenced more than 3 years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

Option 3: Binding Arbitration

Option 2/Option 3: Restrictions

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Option 2/Option 3: Exceptions to Informal Negotiations and Arbitration

The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.

If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to the Site, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

DISCLAIMER

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK.
